Georgia DUI Penalties: What You Need to Know About First, Second, and Third Offenses

Georgia has some of the strictest DUI laws in the country. Understanding the penalties for each offense level is critical for anyone facing DUI charges in the state.

A first DUI offense in Georgia is a misdemeanor carrying penalties of 24 hours to 12 months in jail, fines of $300 to $1,000, 40 hours of community service, 12 months of probation, completion of a DUI Risk Reduction course, and a clinical evaluation for substance abuse.

A second DUI offense within five years carries significantly enhanced penalties: 72 hours to 12 months in jail, fines of $600 to $1,000, 30 days of community service, 12 months of probation, a 3-year license suspension, and mandatory installation of an ignition interlock device.

A third DUI offense within five years is classified as a high and aggravated misdemeanor. Penalties include 15 days to 12 months in jail, fines of $1,000 to $5,000, 30 days of community service, 12 months of probation, a 5-year license revocation, and publication of your name and photo in the local newspaper.
